Copyright & DMCA Policy

Boardrooms to Backroads Consulting LLC (“B2BC”, “we”, “us”) respects the intellectual-property rights of others and expects every Customer and User of the TrailTrack application (the “Service”) to do the same. We respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (the “DMCA”), 17 U.S.C. § 512, and other applicable law. This Policy supplements our Terms of Service and Privacy Policy.
1. Our commitment
It is our policy to (a) respond to valid notices of claimed infringement relating to Content on the Service, (b) remove or disable access to material we determine, in our discretion, to be infringing or the subject of infringing activity, and (c) terminate access for Users who are repeat infringers, as described below.
2. Reporting alleged copyright infringement (takedown notice)
If you are a copyright owner, or authorized to act on behalf of one, and you believe that Content on the Service infringes your copyright, you may submit a written notification to our Designated DMCA Agent (the “Notice”). To be effective under 17 U.S.C. § 512(c)(3), your Notice must include substantially all of the following six elements:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single Notice, a representative list of such works).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — including, where possible, the URL or specific location of the material within the Service.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the Notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorized to act on the owner’s behalf.
3. Designated DMCA Agent
Send your Notice to our Designated DMCA Agent at dmca@boardroomstobackroads.com (subject line: “DMCA Notice”). Notices may also be sent by mail to: [DMCA agent name & address], Boardrooms to Backroads Consulting LLC. Please note that if your Notice is materially deficient, we may be unable to act on it.
4. What we do on receipt of a valid Notice
Upon receiving a Notice that substantially complies with the DMCA, we may remove or disable access to the allegedly infringing material, and we will take reasonable steps to notify the User who posted it that we have done so. We may also provide that User with a copy of the Notice. Nothing in this Policy requires us to make a legal determination regarding the merits of a claim.
5. Counter-notification
If you are a User whose material was removed or disabled and you believe it was removed as a result of mistake or misidentification, you may submit a written counter-notification to our Designated DMCA Agent under 17 U.S.C. § 512(g). To be effective, your counter-notification must include substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original Notice or that person’s agent.
If we receive a valid counter-notification, we may forward it to the person who submitted the original Notice and inform them that we may restore the removed material in 10 to 14 business days. Unless the original complainant notifies us that they have filed a court action seeking to restrain the User from engaging in infringing activity relating to the material, we may, in our discretion, restore the removed material within that timeframe.
6. Repeat-infringer policy
In appropriate circumstances and at our discretion, we will disable, suspend, or terminate the accounts of Users who are determined to be repeat infringers of intellectual-property rights, in accordance with 17 U.S.C. § 512(i).
7. Misrepresentation liability
Please be aware that, under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Do not make false claims in a Notice or counter-notification.
8. Trademark & other intellectual-property complaints
Complaints regarding alleged trademark infringement or other intellectual-property concerns that are not covered by the DMCA may be sent to legal@boardroomstobackroads.com. Please include a description of the right you claim, the allegedly infringing material and its location within the Service, and your contact information.
9. Limitations
This Policy describes our process for handling copyright complaints relating to Content on the Service; it does not constitute legal advice and does not expand or limit any rights or remedies available under applicable law. We may decline to act on, or may require clarification of, Notices and counter-notifications that do not substantially comply with the statutory requirements.
