Beta / Early-Access Terms

TrailTrack (the “Service”), provided by Boardrooms to Backroads Consulting LLC (“B2BC”, “we”, “us”), is currently offered on an invite-only, early-access basis, and certain features within the Service are labeled “beta”, “preview”, “early access”, or similar (collectively, “Beta Features”). These Beta / Early-Access Terms govern your participation in the early-access program and your use of Beta Features. In this document, “Customer” means the organization or person participating in the program, and “User” means each authorized individual.

1. Scope & relationship to other terms

These terms supplement, and are incorporated into, our Terms of Service and Privacy Policy. If there is a conflict between these Beta / Early-Access Terms and the Terms of Service with respect to Beta Features or early-access participation, these terms control for that subject matter. Capitalized terms not defined here have the meaning given in the Terms of Service.

2. Nature of pre-release software

Beta Features and the early-access Service are pre-release and under active development. They may be incomplete, contain bugs or errors, behave unexpectedly, change without notice, or be suspended, limited, or discontinued at any time. We make no commitment that any Beta Feature will be released generally, retained, or offered on the same terms in the future.

3. No guarantee of availability or data preservation

We do not guarantee the availability, uptime, performance, or continuity of Beta Features. Content created, stored, or processed within a Beta Feature may be reset, corrupted, or deleted, and may not be preserved across changes to the feature. You are responsible for independently retaining your own copies of any important Content used with Beta Features.

4. “As is” / no warranties / no SLA

Beta Features are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law. No service-level agreement, uptime commitment, or support commitment applies to Beta Features, even if an SLA applies to other parts of the Service.

5. Feedback license

We welcome feedback, suggestions, bug reports, and ideas about the Service and Beta Features (“Feedback”). You grant B2BC a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, and otherwise exploit the Feedback for any purpose, including to develop and improve the Service, without obligation, attribution, or compensation to you. You represent that you are entitled to provide the Feedback on these terms.

6. Confidentiality of non-public features

Beta Features and any related non-public information — including their existence, functionality, screenshots, performance, and any documentation we designate as confidential — are our confidential information. Unless we state otherwise in writing, you agree not to disclose, publish, demonstrate, or benchmark non-public Beta Features to third parties, and to use them only for your internal evaluation and use under these terms.

7. Data & backups caution

Because Beta Features are experimental, you should treat data within them as non-durable. Do not rely on a Beta Feature as the system of record for any Content you cannot afford to lose. Where the Service provides export tools, you are encouraged to export Content regularly. See the data-handling and retention provisions of our Terms of Service and Privacy Policy.

8. No fitness for production or critical use

Beta Features are not intended for production, mission-critical, or high-risk use. You must not use Beta Features in any situation where their failure, inaccuracy, or unavailability could lead to death, personal injury, or severe physical, financial, environmental, or property damage, or for any regulated activity that requires a validated, production-grade system.

9. Pricing during beta & transition to paid

Beta Features may be offered at no charge or at a reduced rate during the early-access period. We may, with reasonable notice, begin charging for a Beta Feature, fold it into a paid plan, change its limits, or make it available only on certain tiers when it becomes generally available. Your continued use after such a change, or after the notice period, constitutes acceptance of the applicable pricing. See our Billing & Refund Policy for how paid plans are billed.

10. Right to modify or terminate the program

We may modify, suspend, or discontinue the early-access program, any Beta Feature, or any participant’s access to it at any time, with or without notice and without liability, including to manage capacity, address security or legal concerns, or focus development. We may also impose or change eligibility criteria and usage limits for the program.

11. AI & bring-your-own-key (BYOK) beta caveats

Some Beta Features involve artificial-intelligence functionality and may rely on your own third-party provider key (BYOK) or on connected model-context-protocol (MCP) servers. AI outputs may be inaccurate, incomplete, or unsuitable, and must be reviewed by a human before you rely on them. Usage you incur on your own provider key is billed by that provider and is not part of your Subscription, as further described in our Terms of Service and Billing & Refund Policy. You are responsible for the configuration, security, and lawful use of any keys or connectors you enable.

12. Acknowledgement & acceptance

By participating in the early-access program or using any Beta Feature, the Customer and each User acknowledge and accept the risks described in these terms, including the experimental nature of Beta Features, the absence of warranties and SLAs, and the possibility of data loss or feature discontinuation. If you do not accept these terms, do not use Beta Features.

13. Changes to these terms & contact

We may update these Beta / Early-Access Terms from time to time; the “Last updated” date above reflects the latest version, and your continued participation after an update constitutes acceptance of the revised terms.
